The 5th Circuit Court of Appeals has just declared a major victory for American consumers who like their dishwashers and washing machines to actually clean things! It turns out that President Joe Biden’s team went a little overboard with their water and energy regulations on these handy appliances. But fear not, friends of freedom and choice – the court has come to the rescue!
In a 25-page opinion, the court basically said, “Hold up, Biden! You can’t force folks to use these supposed ‘energy efficient’ appliances if they don’t do the job!” The ruling is a big win for folks who love clean dishes and clothes but had been forced to pre-clean, re-clean, or even resort to good ole’ hand-washing because the “green” machines just didn’t cut it.

Former President Donald Trump’s administration had it right, allowing consumers to choose between machines that take longer but use less water and those that get the job done in an hour or less. The court agreed that the Biden rules were making Americans use more energy and water because, surprise, the so-called “energy efficient” appliances weren’t actually efficient at all!
The Competitive Enterprise Institute (CEI) was all over this, arguing that consumers deserve choices when it comes to their appliances. And guess what? The court agreed! They said the Energy Department overstepped its bounds and didn’t have the go-ahead from Congress to regulate water use. Plus, evidence showed that dishwashers which used to finish in an hour were now taking a whopping 2 1/2 hours to do the same job – talk about a sorry state of affairs!
In celebration of this victory, CEI attorney Devin Watkins was practically doing a victory dance, praising the court for forcing the DOE to follow the law. And you know what else? Consumers’ Research Executive Director Will Hild chimed in, calling this a “huge win for consumers” and a “massive loss” for the Biden administration’s attempts to force their agenda through regulation. Amen to that! Let the people have their clean dishes and clothes, and let them choose the appliances that actually get the job done!
