Governor Greg Abbott has been held accountable by the White House and Department of Homeland Security for the fatalities of three immigrants at the Texas border. Abbott is said to have obstructed federal agents from carrying out emergency rescue operations that were critical in nature. Angelo Fernández Hernández, the White House assistant press secretary, condemned Abbott's actions, describing them as "cruel, inhumane, and dangerous." Abbott was accused by the Biden administration of obstructing the performance of Border Patrol agents' duties, and the administration warned that such interference could impede their ability to respond to emergencies.

In an effort to deter unauthorized border crossings, reports indicate that Texas had cordoned off city parkland and a city-owned golf course in Eagle Pass to federal personnel, including law enforcement. In a memorandum, the Biden-led Justice Department alleged that Abbott's conduct impeded the ability of federal agents to carry out their duties and had the potential to impede emergency responses. Photographs depicting Texas National Guard personnel impeding entry to the region customarily frequented by Border Patrol agents were appended to the memorandum.
Renae Eze, a spokesperson for Governor Abbott, defended the state's actions by blaming "reckless open border policies" of President Biden for the surge in illegal immigration. Texas will continue to deploy additional barriers and law enforcement personnel, Eze emphasized, in order to resolve what she termed President Biden's "ongoing border crisis."
Despite their cognizance of immigrants in distress, Border Patrol agents were denied access to the area where the tragic drowning occurred, according to the Department of Homeland Security and U.S. Customs and Border Protection. Even in an emergency, Texas officials, including the Texas Military Department, refused to grant access to the migrants, according to Representative Henry Cuellar. Roy argued that this measure would effectively improve the operations of the Border Patrol. Conversely, the state was held accountable by Democrats, such as former Rep. Beto O'Rourke, Rep. Henry Cuellar, and Rep. Joaquin Castro. O'Rourke specifically accused Abbott of impeding the Border Patrol's ability to carry out its duties. Abbott refuted these allegations, stating in a radio interview that the only action Texas was not carrying out was murdering border crossers, which would have resulted in murder charges being levied against them by the Biden administration.
