Comey and James Indictments Tossed as Court Uncovers Legal Flaw

A federal judge has thrown out the criminal indictments against former FBI Director James Comey and New York Attorney General Letitia James, finding that the prosecutor who brought the cases was not lawfully appointed and therefore lacked authority to file the charges. The ruling, issued by U.S. District Judge Cameron McGowan Currie, did not address the substance of the allegations but concluded the appointment was improper and invalidated the indictments.

Comey had been accused of making false statements and obstructing Congress, while James faced allegations of bank and mortgage fraud tied to a property purchase — charges both defendants denied and pleaded not guilty to in court. That procedural failure — not an examination of the evidence — is what caused the indictments to be tossed, a legal technicality with enormous political consequence.

The dismissals were entered without prejudice, meaning the Justice Department could try to refile, but practical barriers like the statute of limitations make re-prosecution far from certain, especially in Comey’s case. Expect the DOJ to posture about appeals or refiling, while the reality is that sloppy, politically driven legal work has handed quick relief to two high-profile figures who many everyday Americans thought should finally face accountability.

This outcome exposes a rotten system where justice is too often shaped by Washington gamesmanship rather than impartial law and order. The administration’s decision to install a loyal, inexperienced prosecutor to pursue President Trump’s critics — and the Department’s apparent rush to charge before legal housekeeping was finished — looks more like a political hit job gone awry than a sober pursuit of truth.

Hardworking Americans deserve better than theater and technicalities. Congress and the courts must tighten appointment rules, enforce prosecutorial standards, and stop the revolving-door politicking that lets elites avoid scrutiny while turning the justice system into a weapon. If we truly believe in the rule of law, we should demand transparent, nonpartisan prosecutions and accountability that doesn’t evaporate because of incompetence or political theater.
