DOJ Capitulates to Criminal’s PC Demands, Cites ADA in Trans Case

The U.S. Department of Justice has once again entered the arena of political correctness by filing a statement of interest in a Georgia lawsuit, contending that the denial of transgender care breaches the Americans with Disabilities Act (ADA). Assistant Attorney General Kristen Clarke, of the Justice Department's Civil Rights Division, has asserted that "people with gender dysphoria should be able to seek the full protections of the Americans with Disabilities Act, just like other people with disabilities." This move is seen by some as an unending accommodation to the left's identity politics agenda.

The lawsuit is aimed at the Georgia Department of Corrections, accusing it of violating a transgender inmate's rights under the ADA, the Rehabilitation Act, and even the U.S. Constitution by withholding treatment for transgenderism. Critics argue that the Justice Department should prioritize more significant issues rather than defending the constitutional rights of criminals already being supported by taxpayers. U.S. Attorney Ryan K. Buchanan for the Northern District of Georgia has also weighed in, stating that constitutional protections and the ADA should extend to individuals with gender dysphoria in custody, fueling the perception that the liberal agenda goes too far in coddling criminals.

Simultaneously, in Missouri, the case of Kelly McSean, a transgender inmate convicted of rape and pedophilia, has garnered attention as he filed a civil rights lawsuit after allegedly being denied female undergarments at the St. Francois County Jail and South Missouri Mental Health Center. McSean, known for sexually abusing women and children, including attacking sex offender treatment program staff, has drawn criticism for complaining about not receiving his preferred undergarments. Critics find it perplexing that the ACLU supports the grievances of a violent sexual offender.

McSean is making various allegations of mistreatment, primarily focused on his demand for "gender affirming" items and treatments, notably women's undergarments. His complaints include being addressed by the incorrect gender, feeling demeaned, and claiming discrimination based on his sex. The notion that a convicted rapist and pedophile is seeking sympathy and victimhood for not dressing as he desires is viewed as absurd, tarnishing the justice system's reputation.

With accusations of sexual harassment and claims of severe anxiety, nightmares, and high blood pressure due to mistreatment, McSean seeks damages ranging from $50,000 to $100,000. Adding to the complexity, he implicates the ACLU, alleging the organization's intervention on his behalf. Critics argue that individuals with a history of heinous crimes attempting to present themselves as victims underscores the absurdity that unfolds when political correctness spirals out of control.
