In a recent open letter, two liberal law professors, Mark Tushnet from Harvard and Aaron Belkin from San Francisco State University, have brazenly urged President Joe Biden to ignore Supreme Court rulings that they deem “mistaken.” These leftists are advocating for Biden to practice what they call “popular constitutionalism,” which essentially means he should do whatever he wants, regardless of what the Constitution or the highest court in the land says. How convenient!

But here’s the kicker: Tushnet and Belkin specifically use the example of race-based affirmative action in college admissions to make their case. They argue that since the Supreme Court has placed restrictions on using race as a factor in admissions, Biden should simply ignore the court’s rulings and continue implementing his own interpretation of the Constitution. Talk about selective listening!
It’s ironic that Tushnet and Belkin would bring up affirmative action because polls continually show that the majority of Americans, even in liberal states like California, do not support using race as a factor in college admissions. So, these professors are essentially advocating for Biden to disregard the will of the people and the Supreme Court in favor of their own radical agenda. How democratic of them!
Let’s be clear: America’s system of government depends on the three branches—Congress, the executive branch, and the judiciary—operating within their intended roles. Congress makes the laws, the executive branch enforces them, and the Supreme Court strikes down any unconstitutional laws. What these professors are proposing is a complete abandonment of the Constitution and the establishment of a tyrannical regime where the president acts like a king, making decisions based on his personal whims instead of the rule of law. This is dangerous and fundamentally undemocratic.
It’s important to remember that just a few years ago, these same professors were quick to label former President Donald Trump a tyrant for his actions. But now, they want a president they “like,” such as Biden, to have unchecked power and ignore the Supreme Court. Their hypocrisy knows no bounds.
The truth is, Biden is already showing signs of acting like a tyrant. He has ignored the Supreme Court and legal experts to pursue his own agenda. He surrounds himself with sycophantic advisers who will tell him whatever he wants to hear, instead of seeking objective counsel. We are witnessing a constitutional crisis, fueled by a group of partisan elites who only care about power and their own radical ideology.
If we allow Biden to continue down this path, we will no longer be a republic governed by the rule of law. We will be ruled by a tyrant, making decisions based on his personal whims and ignoring the Constitution. This is not the America we know and love. It’s time to stand up against these dangerous calls for tyranny and defend our democratic principles. Our future depends on it.
