In a bold and unapologetic move, the Trump campaign announced on Thursday that they had filed a “powerhouse motion” to hold special counsel Jack Smith in contempt of court for continuing with his 2020 election interference case. The campaign asserted that Smith had been repeatedly violating the stay order in the Washington D.C. J6 Witch Hunt, and President Trump was not having it.

The filing, submitted to Washington, D.C., federal District Court Judge Tanya Chutkan, who is overseeing the case, emphasized the previous order to stay any further proceedings while Trump’s appeal over whether presidential immunity applies to charges Smith has brought against him. Essentially, the court had put a temporary halt to the proceedings, but Smith’s office continued to serve Trump with thousands of pages of “additional discovery” and a “purported exhibit list” for the trial.
Trump’s legal team did not pull any punches, asserting that Smith’s office was seeking to “score cheap political points against President Trump on behalf of the Biden Campaign.” They went as far as to say that such conduct undermines the integrity of the proceeding and warrants severe sanctions.
The campaign demanded that all of Smith’s discovery requests be withdrawn and that prosecutors obtain permission from the court before submitting any further filings. They even called on the judge to impose monetary sanctions on Smith’s office in the amount of President Trump’s reasonable attorneys’ fees and expenses.
The Trump campaign spokesman, Steven Cheung, minced no words, calling out the “Crooked Joe Biden’s henchman, Deranged Jack Smith” for disobeying the stay order and proceeding with what they referred to as harassing litigation. Cheung emphasized President Trump’s duty to investigate the “Rigged and Stolen 2020 Presidential Election” and implied that Smith’s actions were in accordance with the “pathetic Biden Campaign’s corrupt talking points.”
The Trump camp also made it clear that they believed President Trump was carrying out his presidential duties and that the case should be summarily dismissed. They vowed to hold Smith in contempt of court and underscored that “no prosecutor is above the law.”
In stark contrast, Smith’s prosecutors were reportedly seeking to keep the election interference case on track for a March 4 trial date, showing no signs of backing down despite the court’s prior order.
