Black Conservatives Slam Biden Suit Against Sheetz Hiring Policy

Prominent black conservatives have criticized President Biden and his administration for their discrimination lawsuit against Sheetz convenience stores. The lawsuit claims that Sheetz’s criminal record screening process for job applicants violates federal law by allegedly discriminating against individuals based on their race. The Equal Employment Opportunity Commission (EEOC) filed the lawsuit and accused Sheetz of denying employment to a class of job applicants because of their race.

Some conservative figures, such as Republican Utah Congressman Burgess Owens and North Carolina Lieutenant Governor Mark Robinson, strongly oppose the lawsuit. They argue that businesses should have the right to protect themselves, their employees, and customers by screening potential applicants for criminal records. They believe that the lawsuit is baseless and interferes with businesses’ ability to ensure public safety.

Legal experts, including Heritage Foundation’s Hans A. von Spakovsky, have criticized the EEOC’s claim, calling it a dubious legal theory with no basis in the law. They argue that it is reasonable for Sheetz to screen job applicants for criminal history to minimize liability and protect public safety. Sheetz has denied the accusations of discrimination, emphasizing their commitment to diversity and inclusion in their hiring practices.

The EEOC argues that Sheetz’s hiring practices have a disparate impact on black and indigenous people, as criminal background checks disproportionately disqualify them from employment. However, critics point out that the relevance of criminal history in employment decisions is significant and necessary for ensuring a safe work environment. They warn that the EEOC’s enforcement guidance could have negative consequences, such as decreased minority hiring rates and increased employer liability.

Conservatives believe that the EEOC’s focus on the Sheetz lawsuit is misplaced and that the agency should prioritize combating actual illegal discrimination in the workplace. They view the lawsuit as an example of government overreach threatening businesses’ ability to operate efficiently and protect public safety. Despite the legal proceedings, Sheetz remains a popular gas station and convenience store chain with a strong reputation for being a great workplace, as recognized by its ranking in Fortune magazine.
