A federal judge’s block on President Trump’s order to deport suspected Venezuelan gang members has ignited the kind of outrage usually reserved for a triple cheeseburger on a salad-only menu. Judge James Boasberg, appointed by former President Obama, decided to play referee in a game where the stakes are national security and the law against foreign criminals. Representative Brandon Gill from Texas announced plans to file Articles of Impeachment against Boasberg, dubbing him an “activist judge” that insists on overstepping his authority at every turn, apparently oblivious to the real risks facing Americans.

Boasberg’s overreach, as many Republicans see it, involved stopping Trump’s utilization of the Alien Enemies Act, which hasn’t been dusted off since World War II—a historical relic that advocates wondered if it even still worked. This 18th-century legal tool was aimed directly at deporting non-citizen members of the Tren de Aragua gang, a group with a résumé of trafficking drugs, weapons, and people right across the border. It’s unclear whether Boasberg believes that keeping these gang members close is a better strategy than sending them back where they came from, but his ruling certainly suggests a preference for criminal rights over the safety of law-abiding citizens.

The timing of Boasberg’s decision was almost comical, giving a 14-day window for legal challenges from a gaggle of Venezuelan men who chimed in claiming wrongful detention. Meanwhile, the judge not only halted deportation flights but reportedly sent ICE planes already in the air back home, as if they were the wrong fast food order. Such actions have stirred an intense backlash among GOP leaders, who are rightfully questioning how much judicial activism the country can tolerate before it becomes a free-for-all. 

 

Senator Chuck Grassley from Iowa warned of a looming constitutional crisis, following the sound advice that if anyone in a black robe continues to decide policy from the bench unilaterally, the Republic may indeed be at risk. Furthermore, billionaire gadfly Elon Musk weighed in, suggesting that judges who flout the law should at least face the music with an impeachment vote. It’s almost refreshing to see someone with wealth and influence advocating for accountability, especially when it comes to those who wield judicial power like it’s a license to upend established laws.

Despite the hurdles ahead for the impeachment push—namely a majority in the House and a two-thirds majority in the Senate—the Trump administration has vowed to push forward with deportations. The Department of Justice quickly accelerated its appeal efforts, with whispers from within the White House suggesting the exploration of alternative legal avenues, because the American people are more than ready to prioritize their safety over judicial whims. After all, it’s high time to send a clear message that “activist judges” need to think twice before playing games with the rule of law.
