Whistleblower and IRS agent Gary Shapley claims that the investigation of Hunter Biden was handled by the US Department of Justice instead of David Weiss, the top federal prosecutor in Delaware. After he revealed that the agency had interfered with the investigation, his team was removed from the case.

Mark Lytle, the attorney for Shapley, claims that the Department of Justice tried to influence the investigation of his client by scheduling a meeting between Bradley Weinsheimer, the defense counsel for Hunter Biden, and Weiss. According to him, this contradicts the notion that Weiss was independent. After the meeting, the assistant of Weiss, Lesley Wolf, reportedly offered to have the case dismissed with no charges.

According to reports, Andrew Weinsheimer's attitude toward the whistleblowers changed significantly when he was asked to oversee Lytle's disclosures. He then reportedly refused to engage with Lytle and instead redirected her to Weiss. Critics believe that this decision to give Weiss special counsel status prevented Congress from learning more about his investigation of Hunter Biden.

Missouri Congressman Jason Smith, who is the chairman of the House Ways and Means Committee, sent a letter to the inspector general of the Department of Justice, Michael Horowitz, about the alleged mishandling of the investigation of Hunter Biden. He also noted that the IRS had retaliated against employees who revealed information about the case.

In his letter to the chairman of the House Judiciary Committee, Smith accused the Department of Justice of intentionally violating its professional obligations to protect the president's son. These allegations raise concerns about the department's impartiality and integrity.
