Desperate Bid to Block Trump’s Presidency Lacks Legal Basis and Common Sense

As Congress sets the stage to affirm the Electoral College vote and crown Donald Trump as the 47th President of the United States, a peculiar faction obsessed with branding Trump an insurrectionist is working overtime to derail this certainty. Capable of reaching the most ridiculous depths, these proponents published an article that claims Congress can refuse to accept Trump’s electoral votes based solely on an unfounded accusation of insurrection.

The argument they trot out rests on the 14th Amendment’s Section 3, which declares that anyone who has sworn to support the Constitution but has engaged in insurrection is disqualified from holding office. They leap to the conclusion that Trump must be disqualified because a handful of zealots have labeled him as such. This logic exists more in the realm of fantasy than in reality, because, as it stands, accusations alone do not amount to legal guilt.

The supposed evidence of Trump’s insurrectionist status revolves around his impeachment trial. He was charged with inciting insurrection, but in the end, the Senate did not remove him from office. The fact that a few Republican lawmakers joined Democrats in the impeachment spectacle does not change the outcome; Trump was acquitted. This acquittal should have closed the book on the discussion surrounding insurrection, but here we are, faced with more ludicrous assertions from those unable to accept electoral reality.

Another dubious claim comes from a Colorado court ruling, which declared that Trump engaged in insurrection. However, this ruling was swiftly dismissed by the U.S. Supreme Court, affirming that states lack the authority to disqualify federal candidates based on this argument. The Supreme Court made it abundantly clear that enforcing Section 3 of the 14th Amendment requires procedural groundwork laid by Congress, not just some conspiratorial wish list from opposition lawmakers. 

 

Beyond the legal gymnastics and cherry-picking of facts, the ultimate irony is rich. The same self-proclaimed defenders of democracy are advocating tactics dangerously reminiscent of the alleged wrongdoing they accused Trump of in 2020. Their strategy would involve using spurious claims to undermine the democratic process and render the votes of millions irrelevant. By seeking to block Trump’s presidency, they exhibit a blatant hypocrisy that would discredit any genuine concern for democracy.

In a situation that should reveal the absurdity of their position, these individuals want the very institution they claim to protect to play dirty. Under the guise of righteousness, they are willing to bend rules and redefine what constitutes legitimate electoral votes. The fight to uphold what they believe to be democracy comes dangerously close to suggesting that the ends justify the means. This politically motivated maneuver to disqualify Trump based on fraudulent allegations could very well set a perilous precedent that undermines the very foundation of the electoral process.
