The RNC and New Jersey Republicans just did what too many in Trenton refuse to do: they sued. After Governor Mikie Sherrill admitted a Motor Vehicle Commission software problem put thousands of noncitizens on New Jersey’s voter rolls, the party filed a federal lawsuit to force state and county election officials to hand over the list‑maintenance records the law requires. This is a straight fight over transparency, election integrity, and whether New Jersey officials will be allowed to hide what happened.
RNC lawsuit: demand for records, not a fishing expedition
The complaint, filed in federal court, names the RNC, the New Jersey GOP, Rep. Tom Kean Jr., and State Senate Republican Leader Anthony Bucco as plaintiffs. They say they submitted formal NVRA records requests after the governor’s disclosure and gave state officials a deadline. When the deadline passed, they asked a judge to compel production of the documents — spreadsheets, removal logs, audit trails, and other list‑maintenance materials. This is not about politics theater; it’s about enforcing the National Voter Registration Act and getting answers about how roughly 6,600 flagged registrations appeared on the rolls.
Privacy claims vs. public inspection — where the courts come in
New Jersey’s leaders have pushed back, citing privacy and legal concerns over turning over personally identifiable information. That’s a familiar line — and courts have been a mixed bag on these fights. The DOJ’s earlier bid for unredacted voter files in New Jersey was dismissed, and judges nationwide have been careful about the scope of disclosure. Expect the state and counties to ask for heavy redactions or a protective order, and expect the RNC to argue the NVRA requires meaningful access to these list‑maintenance records.
Resignation of the secretary of state complicates matters
Adding to the chaos, the lieutenant governor and secretary of state who was named in the complaint, Dale Caldwell, has resigned amid an ethics and harassment probe. That resignation doesn’t make the RNC’s questions go away; it may slow the state’s response and leave election administration in transition at a sensitive moment. Meanwhile, the state’s own review has shown roughly 4,500 removals and under 400 of the flagged registrants appeared to have cast ballots — numbers worth explaining, not burying.
Why voters should care — and what to watch next
This lawsuit will force a court to weigh transparency against privacy claims and to clarify what the NVRA really requires. With midterm elections approaching, voters deserve to know how noncitizen registrations happened, who fixed them, and whether any eligible voters were wrongly targeted. If officials want trust, they should welcome the sunlight. If they prefer secrecy, the courts will have to decide which side wins — and the public will judge the outcome at the ballot box.
