The Supreme Court has slapped down Judge James Boasberg with a ruling that essentially tells him to take a hike. The highest court in the land has affirmed that the Trump administration rights to deport illegal aliens, invoking the Alien Enemies Act—and there’s absolutely nothing Boasberg can do about it. The decision has left Boasberg in a huff, as he was reportedly pondering contempt hearings for Trump officials over deportation flights, a move that showcases just how far removed from reality this judge has become.
In what might be the judicial edition of a temper tantrum, Boasberg recently attempted to block the deportation of alleged gang members to El Salvador without due process. Naturally, this left Trump and his supporters hot under the collar, leading to calls from various corners, including Republican lawmakers and social media influencers, for the judge’s impeachment. With all the fuss, even constitutional scholars weighed in, cautioning the need to respect the independent legal system. But when a judge starts acting like a soap opera villain, it might be time for some level-headed intervention.

During his most recent stunt in court, Boasberg seemed to throw a fit worthy of a child denied dessert as he grilled a Justice Department lawyer. He suggested there was some conspiracy behind the government moving deportees onto planes before he could even think about throwing one of his famous tantrums. His disbelief over the government’s actions was palpable, as he tried to wrap his head around the fact that planes had left U.S. airspace without his say-so.
The situation continued to spiral as Boasberg demanded explanations for the deportation of over 130 Venezuelans, and quite dramatically, the Justice Department lawyer pointed out that the planes had already left. The judge’s incredulity was comical; he likened the notion that an oral order could carry weight without being in writing to a “heck of a stretch.” That’s one way to cover up a lack of logic.
Meanwhile, calls have grown louder for Congress to rein in rogue judges like Boasberg. Impeachment or the dissolution of district courts that embrace this activist mentality has been proposed by conservatives who have had enough of these judicial power grabs. While Boasberg might dream of throwing contempt orders around like confetti, the reality is his chances of enforcing anything are slimmer than his grasp on the Constitution.
As one observer quipped, there’s a 0% chance that Boasberg’s contempt order will see the light of day—just as there’s a 0% chance those planes full of alleged foreign terrorists would be coming back. When it comes to legal proceedings, a little dose of reality might do Judge Boasberg a world of good. Instead of escalating tensions and trying to single-handedly instigate a constitutional crisis, it might be best for him to take a deep breath, accept the loss, and remember who holds the real power in our legal system.
