The case was brought by the Christian legal group Alliance Defending Freedom, who challenged the Food and Drug Administration’s decision to expand access to the drug, including through mail delivery. They argued that the FDA’s decision to remove certain safeguards, such as requiring a doctor’s visit before prescribing the drug, was unlawful and put women’s health at risk.
Erin Hawley, a lawyer for ADF, stated, “Every court so far has agreed that the FDA acted unlawfully in removing common-sense safeguards for women and authorizing dangerous mail-order abortions. We urge the Supreme Court to do the same.”
On the other side, the White House press secretary, Karine Jean-Pierre, expressed concern that the previous ruling “threatens to undermine the FDA’s scientific, independent judgment and would reimpose outdated restrictions on access to safe and effective medication abortion.”
This case will mark the most significant abortion case heard by the Supreme Court since it overturned Roe v. Wade, returning the issue of legal abortion back to the states.
