Biden’s DOE Undermines Women’s Sports, Destroys Title IX

The Biden Administration’s Department of Education (DOE) is once again overstepping their authority. This time they are attempting to rewrite Title IX of the Education Amendments of 1972 in a way that could undermine not only the integrity of women’s sports but also the rights of accused individuals. The proposed regulation will put women’s sports at risk by allowing biological males to participate in their competitions. This undermines the efforts GOP officials have made to promote the integrity of women’s sports and keep sport fair, safe, and level for all the participants based on biological sex.

Additionally, the Trump-era policy, which required live hearings for sexual misconduct investigations, would be canceled. This means that the DOJ would shift responsibility to a “single investigator model,” which would put at risk the due process of the parties involved in sexual misconduct cases. This politicized environment surely needs to maintain multiple investigators to ensure a fair and impartial process. It doesn’t make any sense for the DOE to concentrate the investigative authority for such cases on one person.

The proposed new regulation would tighten the definition of sexual harassment to the point that innocent actions taken by K-12 teachers could be considered violations. So even basic biological differences between sexes such as calling a trans female-to-male student “Mr. So and So” instead of the name they prefer would be considered a harassment claim that would require a separate Title IX investigation. That’s an overreach of DOE’s jurisdiction!

We must remember that Title IX is an equal opportunity law that promotes fairness in women’s and girl’s sports. Allowing biological males to take the spots of female athletes undermines the principles of Title IX, which have allowed women to achieve milestones in athletics. This new policy would demolish all that women have fought for and accomplished in sports. Half of the US’s governors have signed a petition to stop the policy, alleging that the “proposed regulation would turn the purpose of Title IX on its head and threaten the many achievements of women in athletics.”

Despite all the comments against the proposed policy, the administration intends to finalize it for the upcoming 2023-2024 school year. Clearly putting politics ahead of education and fairness. This administration’s overreach is both ridiculous and an attack on our core principles. The DOE should concentrate on education policies rather than on eliminating men’s and women’s differences in competitive sports games.
