Senate Minority Leader Mitch McConnell criticized Democratic Senators Richard Blumenthal and Sheldon Whitehouse, accusing them of potentially violating ethics standards by demanding Supreme Court Justice Samuel Alito’s recusal over flags displayed at his residence. Blumenthal and Whitehouse had called for Alito to step down from certain cases involving former President Donald Trump, citing concerns about conflicts of interest. McConnell pointed out that both senators are members of the Supreme Court Bar, which they had joined after arguing cases in front of the Supreme Court.
McConnell raised objections to the senators’ actions, noting that they had engaged in what he described as “ex-parte communications” by writing directly to Chief Justice John Roberts to push for Alito’s recusal. He emphasized that such actions could be considered unethical and a violation of the American Bar Association code of conduct. McConnell expressed his disapproval of what he characterized as attempts to pressure justices into making decisions based on political preferences rather than legal considerations.

The controversy stemmed from reports that an upside-down American flag, associated with the “Stop the Steal” movement, had been flown outside Alito’s home, along with a second flag bearing the phrase “Appeal to Heaven.” Despite calls for recusal, Alito asserted that he and his wife were unaware of the significance of the flags and that the incidents did not warrant his withdrawal from the cases under the court’s code of conduct. McConnell stood by Alito’s decision not to recuse himself and criticized the Democratic senators for their perceived overreach in attempting to influence judicial proceedings.
